CLIENT AGREEMENT AND CONTRACT
Agreement Understanding: This contract is written for the purpose of family or personal photo sessions. The signing of this contract states that the client understands that it is their choice to participate in these photos. The client is agreeable to the terms, conditions and timeline of the session and delivery of images.
Limit of Liability: Carlie Leach Photography (CLP) will never make the client pose in any way that they are not comfortable doing. The client always has the choice to not do any shot suggested by CLP. CLP is not liable for injury if the client chooses to do anything that results in such. CLP takes the utmost care with respect to exposure, transportation and processing of the photographs. However, in the unlikely event that the photographs have been lost, stolen or destroyed for reasons beyond CLP’s control, liability is limited to the return of all payment received for the session. As well, in the unlikely event that the photographer is injured or becomes too ill to photograph the session, liability is limited to the return of all payments received for the session.
Model Release: The copyright to the photographs belong to CLP absolutely and are protected by federal copyright law. CLP may, at their discretion, use the photographs as part of promotion and portfolio/website. The client agrees they may not copy, duplicate, print or distribute the photographs in any way unless rights have been given by CLP. If the client displays photos taken by CLP on social networking sites, the client must give credit to CLP for the photo. All images purchased by the client are for personal use only and may not be used for any sort of publishing or selling for profit without express consent from CLP. Client may not alter the final images given to them by CLP in any way.
Rescheduling: If anyone in the session becomes ill, please contact CLP as soon as possible to reschedule. Please be aware that during busy season CLP is booked months in advance. CLP will try to accommodate your session reschedule as soon as possible. Likewise if the photographer is sick, CLP will contact you as soon as possible. In the case of weather that is not suitable for a session, CLP will always contact the client on the day of the session to discuss the possibility of a reschedule.
Appearances: In the event that the client would like additional photos due to appearance out of CLP’s control (hair, makeup, clothing, cloudy weather) in the previous session, the client will be charged for an additional session.
Payments: The client is required to make payment to CLP before the scheduled session can take place to reserve the date of the session. CLP reserves the right to refuse services if the payment agreement has not been met unless prior arrangements have been made.
Refund policy: The session fee secures your session date, covers photographer’s time, talent, post production and provides an online gallery from which to view your portraits. Session fee is non refundable after the session takes place. If client cannot make scheduled session date or find a date to reschedule, half of session fee will be refunded to client. Due to the digital nature of the products, all sales are final. However, if you find that there is an issue with an image received from CLP, please contact CLP immediately.
After the session: CLP will provide you with a sneak peek of your session provided you agree to the posting of images on social media site of CLP. Post processing takes approximately 1-2 weeks. At that time you will be contacted by CLP with an online gallery from which to choose your portraits. The gallery is available to you for 7 days (after 7 days there will be a $25 fee to retrieve images from archives). During this time it is the responsibility of the client to decide on an order and schedule a consultation if needed to discuss image choices, print choices and/or wall display options with CLP. It is highly recommended to print your portraits with CLP to receive the best possible quality and cropping. CLP is not responsible for the quality of products printed outside of their own professional lab, or the color and cropping choices that other labs choose to make.
